Malta has recently secured an important development for its maritime sector, with Maltese-flagged pleasure yachts now eligible to apply for United States cruising licences.
The change follows the inclusion of Malta on the list of countries whose pleasure yachts may benefit from cruising privileges under 19 CFR § 4.94(b), applying to Malta since 10 June 2026.
For yacht owners, this introduction offers several practical advantages. Licensed vessels may be exempt from certain customs entry and clearance formalities, tonnage duties, permits to proceed, and various administrative charges. In addition, yachts holding a valid cruising licence are generally able to move between US ports without the need to complete repeated entry and clearance procedures at every destination, reducing paperwork and operational delays.
The development is expected to strengthen Malta’s position as a preferred jurisdiction for yacht registration, particularly for owners who regularly cruise in the United States. The reduced administrative burden and potential cost savings provide an additional incentive for selecting the Malta flag when registering a private yacht.
It is important to note, however, that the arrangement applies exclusively to Malta-flagged yachts used for private pleasure. Commercially operated yachts do not qualify for the US cruising licence regime. Furthermore, obtaining a cruising licence is not automatic upon registration under the Malta flag. The yacht owner must submit an application to the relevant US port director, and any licence granted may be issued for a maximum period of twelve months.
Owners and masters of licensed yachts must also continue to comply with all applicable US customs, immigration, safety and navigation requirements. While the framework offers a number of administrative and financial advantages, yacht master’s remain subject to certain reporting obligations, including the requirement to report arrivals at US ports to the appropriate customs authorities.
The development is also expected to enhance Malta’s attractiveness as a jurisdiction for private yacht registration. For maritime professionals advising on ownership structures, vessel registration and flag selection, the availability of US cruising privileges introduces an additional factor that may influence registration decisions, particularly for owners who regularly include the United States in their cruising itineraries.
